This document is a template intended to be reviewed by legal counsel before launch.

Agreement

These Terms of Service (“Terms”) govern your access to and use of the EverUptime service. By using the service, you agree to these Terms.

The service

EverUptime provides uptime monitoring, incident management, on-call, status pages, and related capabilities. Features and limits vary by plan, and the service evolves over time.

Accounts

You are responsible for your account, for the accuracy of the information you provide, and for maintaining the confidentiality of your credentials. You must be authorized to act on behalf of the organization you register.

Acceptable use

You agree not to misuse the service, including by attempting to disrupt it, access it without authorization, or use it to violate the rights of others or applicable law.

Plans and billing

Paid plans are billed according to the plan you select. Fees, limits, and billing periods are described at signup and on our Pricing page. Unless stated otherwise, fees are non-refundable except as required by law.

Availability

We work to keep the service available and reliable, but the service is provided on an “as is” and “as available” basis. Any specific availability commitments are set out in a separate agreement where applicable.

Data

Your use of the service is also governed by our Privacy Policy and, where applicable, our Data Processing Addendum.

Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these Terms or as required by law.

Changes

We may update these Terms. Material changes will be communicated, and continued use after changes take effect constitutes acceptance.
